Our Studio, has represented the citizens M.B and E.B at the Court of First Degree Tirana and the Court of Appeals in the civil case with the object “Declaration of termination of bail”, provided by Article 600 of the Civil Code, which comes from a bank loan agreement.
As a result of the detailed analysis of the case, as well as the terms of the Bail, the case ended successfully in favor of the clients because the creditor’s right had fallen into decadence, as it was not exercised within the preclusive deadlines, as a result of this fact, the right over the guarantor was extinguished and consequently the collateral assets were not subject to the process of execution of the obligation.
