Our Studio, has successfully represented, before the European Court of Human Rights, the citizen F.H in the case of violation of process and the claim for damages caused by the Albanian state, due to the trial by Albanian courts that has judged the same case by the same court, with the same parties, and with the same court object, violating in this process the principle of res judicata.
In this case, the European Court found a violation of Article 6 of the European Convention on Human Rights, as the due process was flagrantly violated, the res judicata principle.
The court, in pursuant to the Convention, as well as in the evidence of judicial procedural violations, decided in favor of the klient by finding violations committed by the Albanian justice system, deciding the compensation of the damage caused to the F.H citizens from the Albanian State, awarding economic and moral costs to the Client.
